What these terms are, and how to read them
These terms set out the deal between you and Fermented Pickles. They cover what you can do on the Service, what we can do, and what happens when something goes wrong. They apply to the Fermented Pickles website and any related features that link back here (together, the “Service”). Using any part of the Service means you accept what’s described below. If you don’t, please don’t use it.
We’ve kept things short and tried to write them the way we’d say them out loud. The legal substance is all here, just in plain language. If you also want to know how we handle your personal data, that’s covered separately in our Privacy Notice.
Who can use Fermented Pickles
Fermented Pickles is for anyone aged 16 or above.
You’ll need an account to use most features. When you sign up, please give us accurate information and keep it current. Each account supports up to five separate profiles, so it’s fine to share an account with people in your household, and each profile keeps its own watchlist, ratings, and Toplists.
You are responsible for everything that happens on your account. That means:
- Choosing a strong password and not reusing it on other services.
- Keeping your password and any login codes confidential, and not sharing them with anyone you wouldn’t trust with full access to your account and your data.
- Making sure that anyone you do share the account with (for example, people in your household using the other profile slots) follows these terms when they use it. If they break the rules, it counts against the account.
- Telling us as soon as you reasonably can if you think someone has gained access to the account without your permission, or if you notice activity on the account that wasn’t you.
To the extent the law allows, you are liable for activity carried out through your account, including activity by anyone you’ve given access to and activity by someone who got in because the password wasn’t kept safe. We are not responsible for losses caused by someone else using your account.
If we have reason to believe an account has been compromised, we may temporarily suspend it to protect you and other users while we investigate, and we’ll let you know.
Your licence to use the Service
We give you a personal licence to use Fermented Pickles for the things it’s designed for: tracking what you watch, rating it, organising it, and sharing it with people you choose. The licence is free, and we don’t charge you for it. You cannot transfer the licence to anyone else, and you cannot sublicense it.
The licence is for personal use. You cannot use Fermented Pickles to build a competing product, scrape it for someone else’s database, or otherwise commercialise the access we give you.
What we expect from you
The short version: be a decent user. The longer version is a list of things you must not do.
You must not:
- Use Fermented Pickles to harass, threaten, defame, or impersonate anyone, including other users and our team.
- Post content that is illegal, hateful, or designed to incite violence or discrimination.
- Post content that sexualises minors. This is the one thing we have zero tolerance for. Where we become aware of apparent child sexual exploitation, we will report it to the relevant authorities.
- Try to extract personal information about other users, or use the recommendation or follow features to send unsolicited bulk messages.
- Create accounts or profiles in someone else’s name, or pretend to be someone you’re not.
- Manipulate the Service. For example, mass following to boost your account, gaming Toplist rankings, or running multiple accounts to skew anything.
- Upload anything that contains malware, exploits, or other code intended to cause technical harm.
- Reverse engineer the Service, scrape it with bots, or copy significant portions of it. Normal use through a browser is fine. Running automated tools against it is not.
- Remove or bypass any copyright notice, trademark, or technical protection on the Service.
- Embed or frame the Service inside another site without our permission.
- Probe or test the Service’s security. If you think you’ve found a vulnerability, please tell us.
- Use Fermented Pickles to do anything illegal under Swedish or EU law.
If you break these rules, we may remove the content, restrict what you can do, suspend your account, or close it, depending on what you did. Where it’s reasonable to do so, we’ll explain why and give you a chance to respond.
The things you put on Fermented Pickles
When you use Fermented Pickles you create things: ratings, notes, Toplists, recommendation messages, profile pictures, sometimes poster images. Together we’ll call these your “Content”.
Your Content stays yours. We don’t claim ownership of your ratings, your notes, your Toplists, or anything else you put on the Service.
What you let us do
To run the Service and do the things a platform like this needs to do, you give us a licence to your Content. The licence is non-exclusive, royalty-free, worldwide, perpetual, irrevocable, fully transferable, and sublicensable. Under it, we (and anyone we sublicense to) can use, host, store, copy, reproduce, adapt, modify, translate, distribute, publish, publicly display, publicly perform, and otherwise exploit your Content (including for commercial purposes), together with any name, username, or profile picture you post it under. This covers, for example:
- operating the Service: storing your Content, displaying it to the people your privacy settings allow, indexing it, generating metadata from it, backing it up, and moving it between systems;
- improving the Service: analysing Content for research, moderation, content targeting, security, and product development;
- promoting the Service and the wider Fermented Pickles community on the Service itself, on social media, and in other media, including in connection with promoting a film or series, provided we do not use your Content in a way that is misleading.
You keep ownership of your Content. The licence above is what makes it legally possible for us to do all of the things the Service is built to do with the Content you post. The licence continues even after you delete Content or close your account, to the extent we already used your Content under it (for example, in earlier promotional material) and to the extent we need it for backups, legal records, and similar operational reasons. We will still stop displaying deleted Content on the Service, and we will still delete personal data as described in the Privacy Notice.
Nothing in this licence overrides the rights you have as a consumer or as a data subject under Swedish or EU law, including your rights under the GDPR.
What you’re promising us
When you post Content, you’re confirming that it’s yours to post, that you wrote it, took the picture, or have permission to share it, and that it doesn’t infringe anyone else’s rights or break any of the rules above. Please do not upload any images that violate any copyright, trademark, or personal image rights.
Removal
We don’t screen what people post in advance, and the user who posted something is the one legally responsible for it. We may remove Content if it breaks these terms or the law, or if a court or competent authority asks us to. Where the law requires it, we’ll tell you what was removed and why.
Other users’ content
Because Fermented Pickles lets people share what they watch and what they think about it, you may come across content posted by other users that you find objectionable. We’re not responsible for what other users post.
Our content and trademarks
The Fermented Pickles name, logo, design, code, and the way the Service is put together belong to us (or to the open source projects and providers we rely on, who keep their own rights). We don’t give you permission to copy, redistribute, or rebrand any of that beyond what these terms allow.
Any rights we don’t expressly grant you in these terms are reserved.
Feedback you send us
If you send us feedback, comments, ideas, suggestions, or bug reports about Fermented Pickles (together, “Feedback”), thank you. To make it easy for us to act on Feedback without having to chase legal permissions every time, the following applies whenever you send us Feedback:
- You confirm that the Feedback is yours to share, that sending it to us doesn’t break any agreement or right held by anyone else, and that it doesn’t contain anyone else’s confidential information.
- You give us a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, transferable, and sublicensable licence to use the Feedback for any purpose connected with Fermented Pickles or our business. That includes building it into the Service, sharing it with the providers we work with, using it in marketing, and developing new features based on it.
- We’re not under any obligation of confidentiality with respect to Feedback, and we may already be working on something similar.
- You waive any moral rights in the Feedback to the extent the law allows you to.
- You’re not entitled to compensation for Feedback, and sending us Feedback doesn’t create any partnership, employment, or agency relationship between us.
This section is about Feedback you actively choose to send us about the product. It does not apply to Content you post on the Service (your ratings, notes, Toplists, and the rest), which is covered in the section above.
This section keeps working after you close your account.
Third party services we rely on
Fermented Pickles is built on a few external services:
- Supabase handles authentication, the database, and storage of files you upload.
- Cloudflare hosts the site and delivers it to your browser.
These providers have their own terms. We’ve chosen them because we trust them to do their job well, but we don’t control them, and if one of them is unavailable, parts of Fermented Pickles may be unavailable too.
If we link to other websites or services, we don’t control them and aren’t responsible for what they do.
When the Service isn’t available
We aim to keep Fermented Pickles running smoothly, but we can’t promise it will always be available, fast, or free of bugs. We may:
- Take parts of the Service down for maintenance, upgrades, or security work.
- Change features, add new ones, or remove ones that aren’t working.
- Discontinue the Service entirely if we have to.
If we make a material change that significantly reduces what you can do on Fermented Pickles, we’ll give you reasonable advance notice through the Service or by email where possible. Because the Service is free, none of these changes give rise to a refund (there’s nothing to refund), and they don’t take away any rights you have under Swedish or EU consumer law.
If something is broken, please contact us. We’ll do our best to fix it during normal working hours.
Closing your account
You can close your account at any time from your settings. When you do, we permanently delete your profile, watchlist, ratings, notes, Toplists, uploaded images, follow relationships, and recommendations, as described in the Privacy Notice. Backups may persist for a short period before being overwritten.
We may close or suspend your account if you break these terms, if we have a legal obligation to do so, or if there’s a serious security or technical reason. Where it’s reasonable to do so, we’ll let you know first and give you a chance to respond. For urgent issues (for example, an account being used to harm other users or our infrastructure), we may act first and explain after.
If we close your account, the licences in these terms end at the same time. The parts of these terms that are meant to keep working after that still do, including the rules about your Content and our content, our liability limits, governing law, the small print at the end, and our right to keep fully anonymised, aggregated data for the purposes described in the Privacy Notice.
Things we don’t promise, and the limits of our liability
Fermented Pickles is provided as it is. We do our best to keep it useful, accurate, and secure, but we don’t make legal guarantees beyond what Swedish and EU law require us to make. In particular, we don’t guarantee that the Service will be uninterrupted, free of errors, or compatible with every device or browser.
Where the law lets us limit our liability, our liability to you is limited to direct damages that were reasonably foreseeable at the time you accepted these terms. We’re not responsible for indirect or consequential losses, lost profits, or losses caused by things outside our reasonable control (a third party provider going down, your internet connection failing, and so on).
None of this affects rights you have as a consumer under Swedish or EU law that cannot be limited by contract. If anything in these terms conflicts with those rights, those rights win.
We’re also not liable for what other users do on the Service. If you have a dispute with another user, please try to resolve it with them. If there’s something we can usefully do, such as removing harmful content, let us know.
Any claim arising out of or relating to these terms or your use of the Service must be brought within one year of the events giving rise to the claim. After that, the claim is barred. This time limit does not apply where Swedish law, EU consumer law, or any other mandatory law gives you a longer period, in which case that longer period applies.
If you think someone is infringing copyright
If you believe something on Fermented Pickles infringes your copyright or another intellectual property right, please contact us with:
- Your name and contact details.
- A description of the work you say has been infringed.
- A link or clear description of where the allegedly infringing content sits on Fermented Pickles.
- A statement that you have a good faith belief that the use isn’t authorised by the rights holder or the law.
We’ll review the report and act in line with Swedish and EU law, including the Digital Services Act. Knowingly false reports may have consequences for the reporter.
Changes to these terms
We may update these terms. For example, when the Service changes, when the law changes, or when we just realise something needs to be clearer. If a change materially affects you, we’ll tell you in advance through the Service or by email. Continuing to use Fermented Pickles after a change takes effect means you accept the updated terms. If you don’t accept them, you can close your account.
The current version is the one published on this page, with the “last updated” date at the top.
Governing law and where disputes are heard
These terms are governed by Swedish law. If a dispute can’t be resolved directly, the case will be heard by the competent Swedish courts.
If you live in another EU country, this doesn’t take away your right to rely on the consumer protection rules of that country where they apply to you.
A few small things
- Severability. If any part of these terms turns out to be unenforceable, the rest still applies.
- No waiver. If we don’t enforce something straight away, that doesn’t mean we’ve given up the right to enforce it later.
- Assignment. We may transfer our rights and obligations under these terms to another company (for example, in a merger or acquisition), as long as it doesn’t reduce your rights. You can’t transfer yours without our permission.
- Force majeure. We’re not responsible for failing to do something under these terms when the cause is genuinely outside our reasonable control.
- No third party beneficiaries. These terms are between you and us. They don’t give rights to anyone else.
- Electronic communication. By using Fermented Pickles, you agree that we can send you legal notices and communications electronically, normally to the email address linked to your account.
- Entire agreement. These terms, together with the Privacy Notice and the Cookies and Advertising Choices, are the full agreement between you and Fermented Pickles about the Service.
